1. Acceptance of Terms
By accessing or using Tintly, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Tintly provides a cloud-based business management platform designed for auto appearance shops, including window tinting, paint protection film, ceramic coating, vinyl wrap, and detailing businesses. The Service includes scheduling, customer management, communication tools, payment processing, AI assistance, and online booking capabilities.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password used to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. Payment Terms
Certain features of the Service require payment. You agree to provide current, complete, and accurate billing information. Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by law. Usage-based fees for SMS, calling, and AI are deducted from your prepaid wallet balance. Tintly does not charge platform fees on payment transactions processed through the Service.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Tintly and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tintly.
6. Limitation of Liability
In no event shall Tintly, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may export your data before termination by contacting support. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
